District Judge Lawrence Jahnke ordered today that the initial evidence used to justify the Dec. 1 arrest of Alfonso Rodriguez Jr. be released to the public.

Following is the full text of the "affidavit of probable cause" filed by Grand Forks Police Sgt. James ** Remer.

James Remer, being first duly sworn, deposes and says:

I. That your Affiant has been a law enforcement officer within the State of North Dakota for approximately 13 years. Your Affiant is a graduate of the North Dakota Peace Officer's Academy. Your Affiant is presently a Sergeant with the Grand Forks Police Department and assigned to the Investigative Division. Your Affiant has been involved in the investigation related to the abduction of Dru Sjodin.

II. Your Affiant advises that State, Federal, Grand ** Forks County and Polk County Law Enforcement Departments and officials have commenced a criminal investigation into the possible kidnapping and disappearance of Dru Sjodin - DOB: 9-26-81. Dru Sjodin's home address is ** 370 ** 2 Berkley Drive ** #5, Grand Forks, North Dakota.

III. Your Affiant advises that Dru Sjodin was last seen exiting the Marshall Fields Store into the center of the Columbia Mall in Grand Forks, North Dakota at approximately 5:00 o'clock p.m. on [Saturday] November 22, 2003. Dru Sjodin was observed on the video camera purchasing a ** purse in Marshall Fields at approximately 4:55 p.m. and exiting the store at 5:00 o'clock p.m. carrying a Marshall Field's bag. She was also observed ** talking on a cell phone.

IV. Your Affiant advises that cell phone records indicate an outgoing cell call to Chris Lang, believed to be the boyfriend of Dru Sjodin. A call was made at approximately 5:00 o'clock p.m. Chris Lang advised that at approximately 5:04 p.m., the call ended with Dru Sjodin saying something to the effect of "Okay, okay."

V. Your Affiant advises that no one has seen Dru Sjodin since that time period at the Marshall Fields Store. Your Affiant advises that Dru Sjodin failed to show for work at the El Roco Bar on November 22, 2003 at 9:00 o'clock p.m. as scheduled. Her roommate has also advised law enforcement that she has not been seen at the residence.

VI. Your Affiant advises that the vehicle being driven by Dru Sjodin was located by the UND Police Department in the North parking lot of the J.C. Penney Store on November 22, 2003. Your Affiant advises that the purse of Dru Sjodin and the Marshall Fields bag believed to be the one seen on the video tape earlier in the day, was found in the vehicle. Officers also found her pocket book along with a credit card that was used to purchase the purse in the Marshall Fields Store at approximately 5:00 o'clock p.m.

VII. Your Affiant advises that Dru Sjodin's cell phone made an outgoing call to Chris Lang's phone at 7:42 p.m. on November 22, 2003. Lang advised law enforcement officers that he could hear only static and tones. Your Affiant advises that cell phone records indicate that the call lasted approximately 55 seconds. Your Affiant further advises that cell phone records indicate that the cell phone accessed the Southwest face of Sprint's Crookston Tower near the Fisher rest stop on Highway #2. Your Affiant advises that the telephone remained powered off that tower until approximately 8:00 o'clock p.m. on November 23, 2003 when the tower lost contact with the cell phone. Your Affiant believes that the power on the cell phone was left on until that period of time until the battery died. Your Affiant believes the cell phone was in the general area of the Sprint Tower near the ** Fisher rest stop during this time period.

VIII. Your Affiant advises that on November 22, 2003 at approximately 11:00 o'clock p.m., UND Police Lt. Don Rasmuson located the 1993 Oldsmobile Cutlass of Dru Sjodin's in the parking lot of the Columbia Mall just North of the J.C. Penney Store. Lt. Rasmuson found a black nylon sheath ** with the words Tool Shop in white letters adjacent to the right rear of Dru Sjodin's 1993 Oldsmobile automobile. Lt. Rasmuson noted that ** the passenger door of the vehicle was ** unlocked and the shopping bag previously observed being carried by Dru Sjodin was in her vehicle along with her purse. The keys to the vehicle were missing.

IX. Your Affiant advises that on November 25, 2003, Polk County Minnesota deputies located a black loafer "Nine West" brand shoe was found under the U.S. Highway ** #75 bypass bridge over the Red Lake River on the west edge of Crookston, Minnesota. The shoe was seized by Polk County deputies and was later identified by Dru Sjodin's roommate, Meg Murphy as the type of shoe that Dru Sjodin was wearing on November 22, 2003.

X. Your Affiant advises that during the course of the investigation, law enforcement officers received information that Alphonso Rodriguez Jr., a Level III sex offender, was released from the Minnesota Correctional Facility in ** Moose Lake on or about May 1, 2003. Law enforcement received information from a private citizen that Alphonso Rodriguez Jr. has been in Grand Forks during the afternoon of November 22, 2003.

XI. Your Affiant advises that Alphonso Rodriguez Jr. was interviewed by law enforcement officers on November 26, 2003. Alphonso Rodriguez Jr. advised that he was in Grand Forks, North Dakota on November 22, 2003 during the afternoon hours. Rodriguez Jr. indicated that he had been at the Columbia Mall and went to a movie "Once Upon a Time in Mexico", at a theater located near the Columbia Mall and that that movie ended between 7:00 and 7:30 p.m. on November 22, 2003. Your Affiant advises that officers have determined that the movie, "Once Upon a Time in Mexico" was not being shown at any theater near the Columbia Mall on the date in question.

XII. Your Affiant advises that a consent search was obtained from Alphonso Rodriguez Jr. for the vehicle that he was driving, a 2002 maroon Mercury Sable. Your Affiant advises that a black folding, lockblade knife was observed in the trunk of the vehicle. The knife was not seized during this search which took place on November 26, 2003.

XIII. Your Affiant advises that law enforcement officers have found a black nylon sheath ** bearing the words "Tool Shop" ** in white letters that is sold with a knife through the Menards Store in Grand Forks, North Dakota. Law enforcement officers were advised by Menards employees that the lockable knife and the black nylon sheathing bearing the words "Tool Shop" in white letters can only be purchased as a set and are sold exclusively at Menards Stores. Your Affiant advises that officers have compared the knife and sheath that was obtained at the Menards Store and note that it is very similar to the knife observed in the trunk of the automobile of Alphonso Rodriguez Jr. and the sheath that was seized by Lt. Rasmuson near the vehicle of Dru Sjodin in the Columbia Mall parking lot.

XIV. Your Affiant advises that Minnesota law enforcement officers obtained a Search Warrant on November 27, 2003 and seized a 2002 Mercury Sable automobile bearing Minnesota license #KKY- ** 105 which was the vehicle believed to be operated by Alphonso Rodriguez Jr. The vehicle was searched at the Bemidji Regional Forensic science Office at Bemidji, Minnesota on ** November 28, 2003. This was the same vehicle that the black lockable knife was seen in and eventually seized from. Your Affiant advises that during the search, Minnesota Bureau of Criminal Apprehension agents and scientists observed what appeared to be blood on the inside right passenger side rear window and on the rear seat of the vehicle. Your Affiant advises that two additional areas in the passenger compartment of the 2002 Mercury Sable automobile appeared to contain blood samples. Samples of the suspected blood areas in the 2002 Mercury Sable were secured as evidence and transferred to the Minnesota Forensic Science Lab at Bemidji, Minnesota for DNA analysis.

XV. Your Affiant advises that a toothbrush belonging to Dru Sjodin was secured as evidence from her residence ... for the purposes of securing DNA evidence. The toothbrush was transferred to the North Dakota Crime Laboratory for analysis. It was determined that there was DNA evidence available from the toothbrush and a profile of that evidence was made.

XVI. Your Affiant advises that the Grand Forks Police Department has been in cooperation with Minnesota Law Enforcement including a Minnesota Bureau of Criminal Apprehension relative to this matter. Your Affiant advises that Agent Daniel Ahlquist of the Minnesota Bureau of Apprehension Supervised the transfer of the 2002 Mercury Sable that had been operated by Alphonso Rodriguez Jr., to the Minnesota Forensic Lab at Bemidji, Minnesota. Your Affiant advises that the Forensic Scientist at the Minnesota Bureau of Criminal Apprehension Laboratory in Bemidji obtained samples which were confirmed to be blood samples. Your Affiant advises that the DNA evidence or profile obtained from the 2002 Mercury Sable automobile was compared with the DNA evidence or profile obtained from the toothbrush of Dru Sjodin and the DNA sample of the blood was a match to the DNA sample taken from the toothbrush of Dru Sjodin.

XVII. Your Affiant advises that Dru Sjodin has not been heard from since the telephone call at approximately 5 p.m. on November 22, 2003. Your Affiant further advises that after an exhaustive search by law enforcement and many other individuals, no other evidence has been found of Dru Sjodin at this time.

XVIII. Your Affiant believes there is probable cause to believe that Alphonso Rodriguez Jr. abducted Dru Sjodin for the Columbia Mall parking lot in Grand Forks, North Dakota, on November 22, 2003, and would request that a Complaint and Warrant be issued for the arrest of Alphonso Rodriguez Jr.

** Notes: A search warrant unsealed earlier this week showed about a three-hour gap between the time Sjodin disappeared and the time Rodriguez appeared at his mother's home. Authorities said they do not believe his story that he went to a movie near the mall about the time Sjodin disappeared; they say the movie wasn't showing anywhere near the mall that day.
