CROSS EXAMINATION

Q: Ms. Dye, is the information that you received from Georgia Rudolph always correct?

A: Not always.

Q: How often is it incorrect?

A: Not too often.

Q: So it is more correct than incorrect?

A: Right.

Q: Now, what was the rest of the information you received about this dream that you were looking for?

A: What do you mean?

Q: **Do you recall giving a statement to a Marietta police officer where you related the information that you were acting upon when you made this trip?

A: Yes.

Q: **Do you recall telling them what type of vehicle the person **{would be driving?}

A: I don't believe I told them that, sir.

Q: You don't recall saying **"a black van" with another color in it? Do you remember telling them that?

A: Is that the information Georgia gave me?

Q: That's the way it is written up here.

A: Okay, then that's what she told me.

Q: And that the person lived in the Lower Salem area?

A: I don't believe that's on my statement, sir.

Q: You want to look at it?

A: Yes, I do.

Q: Let me hand you a copy of what I was furnished.

A: Is that the one I wrote?

Q: They didn't give me anything you wrote. Did you write one?

A: Yes, I did.

Q: Maybe I should look at it. You didn't tell the police officer who wrote this report on {{October 3 }} that Georgia Rudolph told you that this person lived in the Lower Salem area? {BMW: Can anybody determine who's the least prepared or the most confused in this picture?}

A: She didn't say he lived there, I don't believe.

Q: And how about the black van?

A: She mentioned a black van.

Q: And I suppose you didn't also tell them that this person who you claim that you saw in a police vehicle had brown hair? / {BMW Note #16 / Not to mention .... long, shaggy, brown hair!! }

A: Ask that question again.

Q: I said, I suppose you also did not tell this officer on ** October 3 that the person that you claim to have seen in this police vehicle had brown hair?

A: He did have brown hair. / {BMW Note #17 / Jackie's hair is closer to black than "brown." Jenifer had brown hair. Besides that his hair was cut so short that it would have been difficult to see what color it was.... especially in the rain, and through an outside, rear-view mirror.}

Q: Now, you are looking at this person while it is raining and you are looking in your outside rear view mirror, correct?

A: Right.

Q: How big is your outside rear view mirror?

A: Big enough that I can see a face in it.

Q: How far away was the face?

A: It wasn't that far away. / {BMW Note #17 / Why will no one insist that she answer these "distance" questions? Why did the defense not go to the area and measure everything? I did. Why the hell didn't the defense?}

Q: Was it raining right at that time?

A: Not right that minute it wasn't.

Q: Had a brief interlude in the rainstorm?

A: Right.

Q: And how many times have you called or left messages for ** { Detective Garvey, the gentleman here at the table,} to try to help him solve ** other crimes ** or mysteries?

A: ** I don't believe I have called him on any other ones, sir.

Whoa. Hold it right here:

Let's go back and see what Mary Dye's answers were to Jim Schneider's opening questions:

*Repeating / Schneider Q: ** Back at that time, did you know who Sergeant David Garvey was?

*Repeating / Mary Dye A: ** Yes, sir, I did.

*Repeating / Schneider Q: ** And how did you know Sergeant David Garvey at that time?

*Repeating / Mary Dye A: ** I had talked to him before that.

*Repeating / Schneider Q: ** On matters not related to Jenifer McCrady?

*Repeating / Mary Dye A: ** Yes, sir.

*Repeating / Schneider Q: ** Different police matters that come up from time to time?

*Repeating / Mary Dye A: ** Yes, sir.

{BMW: Well, here we are folks. She's just contradicted herself again and NO ONE noticed except me! First she says she has worked with Garvey before on police matters: Then Garvey denies knowing her: Then Garvey admits knowing her and Rudolph, but denies that he's ever spoken to them except at John Winstanley's office: Then Garvey admits that he 'may have spoken to Dye a year and a half ago, but he can't remember!: And now, Dye has turned her own testimony around and says she has never contacted Garvey before the McCrady case: {MISTRIAL!!!} It should have been headlines, but it wasn't. Even the cowardly news media went along with this mess, and to this day, I am the ONLY person who obviously has a problem with all the twisted lies that came out in this trial. WHY?}

Before continuing on with Kiger's cross examination of Dye, lets re-examine her testimony concerning Friday, September 27th, 1996, as well as that of Saturday, September 28th, 1996. I want to make certain everyone understands what this woman said. Hopefully, someone out there can understand it, because even after ten years it makes no sense to me:

*Repeating / Schneider Q: And did you try to contact Sergeant David Garvey of the Belpre Police Department on or about Friday, September 27, 1996 about the Jenifer McCrady case?

*Repeating / Mary Dye A: Yes, sir, I did.

*Repeating / Schneider Q: ** Were you able to reach him that day?

*Repeating / Dye A: ** No.

*Repeating / Schneider Q: ** This would have been on what day, ** Friday? [9/27]

*Repeating / Dye A: ** That was Friday after Georgia and I talked.

*Repeating / Schneider Q: And were you successful on either of those days in making contact with Officer Garvey either on the 24th or the 27th?

*Repeating / Dye A: Not on the 24th, but on the ** 27th we talked on the phone.

*Repeating / Schneider Q: Did you attempt to call Officer Garvey on that Saturday with this information?

*Repeating / Dye A: Yes, I did.

*Repeating / Schneider Q: Were you successful in reaching him?

*Repeating / Dye A: No, sir.

*Repeating / Schneider Q: Did you finally make contact with Officer Garvey on Monday, September 30, 1996?

*Repeating / Dye A: Yes, sir, I did.

*Repeating / Schneider Q: And was that at the Belpre Police Station?

*Repeating / Dye A: Yes.

*Repeating / Schneider Q: Is that when you finally told him {everything that had happened on Friday and Saturday} in connection with what you have just testified about? /

*Repeating / Dye A: Yes, sir.

A Belpre Police officer is on administrative leave for suspected criminal activity.

The Bureau of Criminal Identification and Investigation says it's looking into allegations brought against Sergeant Dave Garvey.

BI&I says Garvey has not been charged with anything at this point and it would not release any information regarding the allegations.

The Belpre Police Chief and the Washington County Prosecutor would not comment on the investigation.
