ATTENTION VISITORS:

The following pages of ... "The Dream Seeker" ... will contain actual testimony of both Mary Dye and Belpre Police Officer David Garvey, and comments by me.

All pages are "color coded" for clarity and research purposes. The color code will be repeated on each of the three pages that involve the testimony:

I will present both the prosecution and defense questions and answers for Mary Dye, and those of Garvey's that pertain to Mary Dye or psychic Georgia Rudolph: The rest of Garvey's testimony will be presented in its entirety on other pages, at another time.

I'll be breaking the testimony down, piece by piece and showing any contradictions, as well as presenting a few area maps that my readers might be interested in seeing. Actually, I think the jury should have been interested in such matters, but that's just my personal opinion.

In my opinion, Mary Dye's testimony may have gone further to convict Jackie McCrady for the murder of his wife Jenifer, than any other single witness in the case. She claimed that she had a dream about the missing Jenifer McCrady, and called her psychic friend Georgia Rudolph to interpret the dream.

Dye claimed that she and Georgia Rudolph had been friends since 1978, and that she had phoned Rudolph many times with dreams that she did not understand. Rudolph instructed Dye to "go south, out of Belpre and to Little Hocking," in order to "identify" the dream. And even though Mary Dye and eventually Officer Garvey claimed they were "following Rudolph's directions and advice," Rudolph was never called to testify at the trial, and neither was Mary Dye's mother who was with her the day she claimed to have seen officer McCrady on township road 298.

"She said this ... and she said that .... he said, ... they said and I was told," were common terms heard at the trial of Jackie McCardy. I thought that kind of information was considered hearsay, and inadmissible in a court room ..... guess I was wrong.

I also thought a witness .... any witness ... could not be present in the court room, and hear any other witnesses testimony until after their own testimony. That's how it was for the Barrett family and the McCrady family. They weren't allowed into the court room even after they had testified, just in case they needed to be called back for rebuttal. But the rule did not apply to Officer Dave Garvey. He sat at the prosecution's table throughout the entire trial and heard everyone's testimony before and after his own. Even so, he had difficulty getting things exactly the way the prosecution wanted them .... especially where Mary Dye and Georgia Rudolph were concerned!

Mary's Dream

We do not know the exact date of Mary Dye's dream, but I'm guessing it was 9-23 ... in view of the fact that Dye began trying to get in touch with Officer Garvey on 9-24.

She claimed that in her dream, she saw a woman tied, hand and foot, spread eagle style, held hostage in an old building, close to a trash dump. The woman's "abductor/killer" had shaggy brown hair, drove an old black van, and was from the Lower Salem area. A number was supposedly presented in this dream, but Dye could not remember if it was 98 or 89.

Dye admitted that she found none of the elements from her dream when she followed Rudolph's advice .... except the number 98, that is. I guess she found that, with the number 2 attached to it.

Q: State your name, please.

A: Mary A. Dye

Dye is asked to spell her name, give her address, asked how long she's lived there, asked if she was married, asked her husband's name and place of employment, etc. After the personal info, the first question pertaining to the McCrady case was .....

Q: Now, when did you first read or hear about the disappearance of Jenifer McCrady?

A: Back in September of --

Q: Last year? // BMW: The trial was held in August of 1997. Jenifer was murdered in 1996:

A: Yes.

Q: And how did you first learn about it, that is, what source did you first read or hear about?

A: On the news or in the news paper.

Q: ** Back at that time, did you know who Sergeant David Garvey was?

A: ** Yes, sir, I did.

Q: ** And how did you know Sergeant David Garvey at that time?

A: ** I had talked to him before that.

Q: ** On matters not related to Jenifer McCrady?

A: ** Yes, sir.

Q: ** Different police matters that come up from time to time?

A: ** Yes, sir.

Q: And did you try to contact Sergeant David Garvey of the Belpre Police Department on or about Friday, September 27, 1996 about the Jenifer McCrady case?

A: Yes, sir, I did.

Q: Was that the first time you tried to contact Dave Garvey about the Jenifer McCrady case?

A: No, sir.

Q: When was the first time you tried to contact him about the Jenifer McCrady case?

A: I believe it was on ** September 24th.

Q: And were you successful on either of those days in making contact with Officer Garvey either on the 24th or the 27th?

A: Not on the 24th, but on the ** 27th we talked on the phone. {BMW Note #1: Remember this date ** Friday, 9-27:}

Q: Now, why were you trying to reach Officer Garvey?

A: Because I had a dream about an ** old building that I thought was real important.

Q: All right. And the dream that you had, was there a female in that dream?

A: Yes, sir, there was.

Q: After having the dream, did you attempt to contact someone named Georgia Richards?

A: No, sir, it was Georgia Rudolph.

Q: Georgia Rudolph?

A: uh-huh.

Q: And who is Georgia Rudolph?

A: She is the psychic, I am not.

Q: Do you know where Georgia Rudolph lives?

A: She lives in Pennsylvania.

Q: And do you know Georgia Rudolph?

A: Yes, we are friends.

Q: Do you know her personally?

A: Oh, yes.

Q: ** Did she used to live basically in the Washington County -- Wood County, West Virginia / Washington County, Ohio area?

A: Yes, sir, she did.

Q: When did she move to the Pittsburgh area?

A: I'm not sure of the date on that.

Q: Have you -- up to that point in September of 1996, had you regularly corresponded with Georgia Rudolph?

A: Oh, yes.

Q: Generally how would you correspond, telephone, letter?

A: Telephone.

Q: How long was it that you had known Georgia Rudolph?

A: Georgia and I probably have been friends ** since 1978.

Q: Did you know that Georgia Rudolph claims to be psychic?

A: Yes.

Q: Have you ever claimed to be psychic?

A: I never have.

Q: Do you have dreams from time to time that you can't explain?

A: Yes, sir, I do.

Q: ** What prompted you to call Officer Garvey initially on the ** 24th of September? {BMW: the 24th was a Tuesday}

A: Because I thought {the woman} in my dream {in the old building was Jenifer McCrady.} // {BMW: Please see **'The Real Dummy'}

Q: Was that after you had seen Jenifer McCrady's picture in the news media or on tv or in the newspaper?

A: Yes, sir.

Q: Did you know Jenifer McCrady at all personally?

A: No.

Q: To your knowledge, had you ever met her?

A: No.

Q: Did you know any of her family personally?

A: No.

Q: Did you contact Georgia Rudolph by telephone specifically about your dream and about Jenifer McCrady?

A: We had talked about other things, but we talked about Jenifer.

Q: And did she tell you that Mrs. McCrady was dead?

A: Yes.

Q: Did she mention Dave Garvey's name?

A: Yes, she did.

Q: ** And did she tell you where to look for her?

A: Yes, she did.

Q: What was it that you were told?

A: She told me to go to Belpre, go south out of Belpre on 7, find the numbers eight and nine or nine and eight and ** look for a dump off of this side road, and there would be another road that I would be on, and she said "up there."

Q: The words "up there?"

A: {Up there.} {BMW: Again, I urge my readers to see - "The Real Dummy"}

Q: And did she tell you how far south of Belpre to go?

A: ** She told me it wouldn't be as far south as Torch:

Q: After getting that information, did you look for such a road?

A: That afternoon I tried to call Dave -- yes, I did. {BMW: Whoops .... wrong answer! Someone forgot their line!!}

Q: When you say Dave, you mean Dave Garvey?

A: Dave Garvey.

Q: ** Were you able to reach him that day?

A: ** {{ No.}} {{BMW: The woman has just contradicted herself and thrown the prosecution for a loop! He tries to help her by clarifying what day is in question..... read on}

Q: ** This would have been on what day, ** Friday?

A: ** That was Friday after Georgia and I talked. {BMW: Friday was the 27th of September! **9-27: Remember how I told you to "remember this date?" {See BMW Note # 1} }Previous testimony follows:

Mary Dye's Previous Statements:

* Repeating: Q: And were you successful on either of those days in making contact with Officer Garvey either on the 24th or the 27th?

* Repeating: A: Not on the 24th, but ** on the 27th we talked on the phone.

{BMW: So, which is it folks? Did she or did she not speak to Dave Garvey on September 27th? And, if she had spoken to Georgia Rudolph on 9-27 {as she states} and Rudolph "mentioned Dave Garvey's name" as she stated, then my question remains the same .... WHY WAS SHE SO DESPERATE TO CONTACT DAVE GARVEY ON THE 24TH, THE 25th AND THE 26th? And "if" she had this so called dream on the 23rd of September, why did she wait until 9-27 to contact her psychic friend for interpretation and instructions?? Does 9-27 ring any bells WINSTANLEY? Does "He's going to kill again, probably this month {Sept} if you don't stop him. He's coming into Little Hocking. Tell Belpre they got another strike coming. It will be a cop's woman." Does any of this sound familiar to anyone in Washington County? It should. It's burned into my memory banks like the searing brand of betrayal. See "The Clues" for some real interesting FACTS.}

Back to testimony

Q: And did you set out along State Route 7 south of Belpre looking for these numbers 98 or 89?

A: Yes, I did.

Q: Were you able to find any road signs with those numbers on them?

A: Yes, sir, I did.

Q: What did you find?

A: I found 298.

Q: Did you turn on that road, 298, on that day, that Friday afternoon? {BMW: This was *9-27 / Friday, September 27th, 1996:}

A: No, sir, I did not.

Q: What did you do with that information at that time?

A: I went back home. {BMW: This was 9/27, remember that. She "went back home"?? After caring enough to try to contact Garvey for three days, and then actually finding the numbers she was looking for ... although there's no longer any mention of the old building, the dump or the woman tied up spread eagle style ..... she not only doesn't bother to turn onto road 298, but actually turns around and drives back to Williamstown, West Virginia .... without stopping by the Belpre police department and speaking to Garvey or leaving him a message! Strange .... very, very strange.}

Switching over to Officer Garvey's testimony, concerning Mary Dye's phone calls to him, he states .....

Q:.... During that time frame of September 24 to September 27, had you received any telephone messages from somebody named Mary Dye?

A: Yes, I had received maybe four, maybe five. {I talked with her once.} The other calls I just didn't take. I knew they were from Mary, but I didn't take them. / {BMW Note #2 / And this is the cop who was "begging everyone for help" in finding Jenifer McCrady, who was a resident of his city. If he'd talked to Mary Dye previously, {and I wonder when that was!} then he already knew she was trying to help him find Jenifer. Why would he ignore her calls?}

Q: ... On any of the phone messages that you got from Mary Dye, did you return any of those phone messages?

A: I tried to return one probably two to three minutes after she called me. She didn't answer the phone.

Q: Prior to getting those phone messages, did you know Mary Dye?

A: Yes, sir.

Q: And had you talked with Mary Dye before about other cases you had worked on?

A: {I believe the first time that I met Mary Dye and probably the last time before this happened that I talked to Mary Dye would have been two to three years ago.} I met Mary Dye and Georgia at the same time, they were together.

Q: You met them together through {{**John Winstanley of the sheriff's department?}}

A: {{Yes, sir.}} {I may have talked to Mary sometime a year and a half ago,} but I do not recall. / {BMW Note #3 / The man just testified that he had not spoken to Mary Dye for two or three years. He turns right around and in the very next breath says he "might" have talked to her a year and a half ago .... but he doesn't remember!}

Q: And when was the first phone call or the time you really talked to Mary on the telephone?

A: It was either the {26th or 27th of September} of 1996. / {BMW Note #4 / Must have been the 26th because Dye says she could not reach him on the 27th. Of course she neglected to mention that she had spoken to him { for 15 or 20 minutes!} on the 26th!}

Q: And how long of a phone conversation was it?

A: Fifteen, twenty minutes maybe.

Q: And when did you next see Mary Dye or talk to her after that phone conversation?

A: On September 30th, would have been the following Monday.

Let's compare Garvey's testimony to Dye's testimony:

Dye says she called Garvey one time ... on September 24th: Garvey says she called 3 or 4 times between the 24th and the 27th: Says he knew it was her calling but he just didn't take the calls!

Dye says she "could not" reach Garvey on 9-27, whereas Garvey says he did talk to her but can't remember if it was the 26th or the 27th. No big deal, right? Wrong.

No phone records from either person were produced to verify when any of these calls were made. I found that a little strange too ... at least on behalf of the defense.

Meanwhile, Dye phones Rudolph on 9-27 to ask her about her dream. Rudolph "sees" the area of Dye's dream from Pittsburgh, although she is unfamiliar with this area, { even though Dye has already testified that Rudolph used to live in "this area," although the prosecution did a pretty good job of disguising where or which state.} Rudolph instructs her what direction to head .... "south out of Belpre, but not as far as Torch." See map below:

The following map shows Township Roads 298 and 297: For some reason State Route 7 appears on this map as "32." This is incorrect, as Route 32 is located in Athens County, which does not begin until a mile past road 297.

Torch is located precisely one mile past 297 :

Going back and picking up where we left off on Mary Dye's testimony .....

* Repeating /Prosecutor's Question: "What did you do with that information at that time?"

* Repeating /Mary Dye's Answer: "I went back home."

Q: Did you again call your friend Georgia Rudolph in Pennsylvania? {BMW: And we have to assume that she phoned Rudolph the evening or night of 9-27.}

A: Yes, I did.

Q: Did you tell her that you had seen a road sign that had the numbers 98 on them but there was also a 2 on them, 298?

A: Right, I told her that sir.

Q: As a result of that conversation then, did you elect to go back to Township Road 298 the following day?

A: Yes, sir.

Q: And what day of the week would that have been?

A: That would have been on Saturday.

Q: Would that have been Saturday, the 28th of September?

A: Saturday, the 28th of September.{BMW: Correct - Saturday was the 28th of September}

Q: What time did you leave your home that day to generally head in the direction of Belpre, Ohio? / {BMW Note #5 / She lives in Williamstown, West Virginia / See map:

A: **{2:00 p.m.}

From Williamstown, West Virginia to Belpre, Ohio:

Distance = 13.6 miles: **Est. travel time = 25 minutes:

This would make Mary Dye arriving in Belpre between 2:25 and 2:30 p.m.

Q: Was there anyone with you at that time?

A: My mother was with me. / {{BMW Note #6 / Her mother, the only witness to the claim that she was even there, did not have to testify.}}

Q: Who was driving?

A: I was.

Q: And what were the weather conditions that day?

A: Rainy.

Q: Raining pretty hard that day?

A: At times it was hard. {BMW: this would have made traveling a little slower}

Q: Tell us -- actually give us your direction of travel, where you went on that Saturday, the 28th, after leaving your home at {** "2:00".}

A: I drove to Belpre and "drove around Belpre," and then I went out 618 and drove to 298 and made a right turn onto 298 and drove out through there, and then I turned around.

Following map shows directions from Williamstown, West Virginia to Little Hocking, Ohio: Distance = 20.8 miles: Est. travel time = 39 minutes:

The map shows travel on the four lane, which bypasses the city of Belpre, and cuts down on travel time. Dye testified that she "drove around Belpre for awhile before heading out of Belpre on Rout 618. Again, there was no one to question her time on this trip. Re-enactment of the "experience" took 1 hour. Even if Dye's testimony is correct, she did not reach Belpre until 2:30 pm. It takes five minutes to drive straight through Belpre and hit route 618. That would make it 2:35 if she came straight through Belpre, but that's not what she testified that she did. If she 'drove around" Belpre for awhile, then she couldn't have left Belpre much before 2:40 pm, thus making her arrival in Little Hocking 2:45 pm at the earliest.
